Possession and Property

Possessory actions are process in witch you can file to protect your property from disturbance, treat or expropriation, for example. In addition each one of these problems needs and different possessory action, such as repossession, maintenance of possession and evidentiary interdiction.

Types of Possessory Actions

We will list three ways to protect possession, provided for in the New Code of Civil Procedure. Therefore, there are three mai types of possessory actions, which can be divided into others, according to each case.

They are: prohibitory interdict, maintenance of possession and reintegration of possession.

Prohibitory Interdict

The prohibitopry interdict is an prevetion institute, which means that is used to protect the possession that is iminente or under threat of being molested. 

Maintenance of possession

The maintenance of possession intends to protect the possession against disturbançe and is applicable when the possessor is unable to exercise the possession calmly, due to na act of another.

Possession Reintegration

The reintegration of possession is the necessary measury when there is exporpriation, which means when the possession is total molested unjustly, throught violence, clandestinity, or precariousness. This is an act to recover lost possession.
